NOTICE OF NONDISCRIMINATION

  1. Our Nondiscrimination Policy

Cal American Dental complies with applicable federal civil rights laws and does not discriminate on the basis of race, color, national origin, sex, age, or disability. Cal American Dental does not exclude people or treat them differently because of race, color, national origin, sex, age, or disability.

  1. Applicability of This Notice

This notice is provided under Section 1557 of the Affordable Care Act (42 U.S.C. § 18116), which prohibits discrimination on these grounds by health programs and activities that receive federal financial assistance. Cal American Dental participates in Medicaid, which makes this notice applicable to our practice.

  1. Additional Protections Under California Law

Separately from the federal protections described above, the California Unruh Civil Rights Act (Cal. Civ. Code § 51) independently prohibits discrimination by California businesses, including this practice, on the basis of sex, race, color, religion, ancestry, national origin, disability, medical condition, genetic information, marital status, sexual orientation, citizenship, primary language, or immigration status. These state-law protections apply regardless of the current status of any federal rule or litigation concerning the scope of Section 1557, and Cal American Dental does not discriminate against patients on any of these grounds.

  1. Language Assistance Services

Cal American Dental provides free language assistance to patients with limited English proficiency. Dr. Jara is fluent in both English and Spanish and communicates directly with patients in either language. For patients who need further assistance, our practice also has access to a telephonic interpreter service through Medical Dental. Patients are also welcome to bring a family member or other person to assist with communication if they prefer.

Section 1557 also requires covered entities to provide a Notice of Availability of Language Assistance Services in English and in the fifteen languages most commonly spoken by individuals with limited English proficiency in California. This additional translated notice has not yet been prepared and should be completed as a separate compliance item.

  1. Auxiliary Aids and Services for Individuals with Disabilities

Cal American Dental provides appropriate auxiliary aids and services free of charge to people with disabilities to ensure effective communication, consistent with our Accessibility Notice.

  1. Civil Rights Coordinator

Section 1557 requires covered entities with 15 or more employees to designate a Civil Rights Coordinator responsible for compliance with this notice. This requirement may not apply to a practice of this size; however, Cal American Dental has chosen to designate the following individual in this role as a matter of good practice:
